Charlottesville Brain Injury Lawyers | Virginia Personal Injury Attorneys

For years, traumatic brain injuries (TBIs) went undiagnosed and were usually impossible to treat. However, medical science has made significant strides in recognizing the symptoms and causes of TBI. Warning signs that were once routinely ignored can now be diagnosed and treated. But despite these breakthroughs, a lifetime of treatment and rehabilitation awaits most people who suffer TBIs.

Tucker Griffin Barnes P.C. works with clients to get them the compensation and financial support they need for their serious injuries. If you or a loved one has suffered head trauma and would like to know more about your legal options, our attorneys can assist you.

There are two types of TBI

Traumatic brain injury falls into two broad categories, each with its own distinctive characteristics. Researchers have classified TBIs as:

  • Open TBI — An open TBI results when the skull is fractured or penetrated by an outside force. Damage to the skull usually means there has been a violent act that has also damaged the brain. Such wounds often leave those affected unable to work or generate income — and in need of extensive long-term support and assistance.
  • Closed TBI — A closed TBI results from an impact to the head that doesn’t penetrate the skull. Closed TBIs were long thought be less serious than we now know them to be. Recent studies have shown that victims of closed TBIs suffer permanent effects including irritability and memory loss, and their condition may be linked to other diseases such as Alzheimer’s and Parkinson’s.

Either form of TBI requires medical assistance, which can be expensive and may not be covered by insurance.

Traumatic brain injuries have many sources

TBIs can have many causes, and each carries important legal differences. A minor car crash or something simply landing on your head can result in mild TBI. More severe cases lead to a cause of action for wrongful death. A few common sources of TBI include:

  • Vehicle Accidents
  • Daycare Accidents
  • Recreation Park Accidents
  • Motorcycle Accidents
  • Slip and fall Accidents
  • Pedestrian Accidents

Any injury to your head or brain caused by someone else’s actions may entitle you to legal compensation. Our attorneys can explain more.

What are the symptoms of TBI?

Open TBI is easily diagnosed, for obvious reasons. But the signs that point to a closed TBI are often much more subtle. Doctors diagnose it through symptoms including:

  • Chronic headaches
  • Seizures
  • Aggressiveness or irritability
  • Fatigue
  • Slurred speech
  • Sluggishness

The greater the injury, the more pronounced the symptoms are likely to be: Mild or moderate TBIs are often accompanied by strong headaches or feelings of fatigue, while more significant TBIs may leave victims unable to speak. And in other cases, symptoms take time to manifest themselves, delaying diagnosis and treatment. That’s why it’s important to see a doctor immediately if you’ve suffered head trauma of any kind, no matter how mild you think it may be.
