The attorneys at TGB understand the foreclosure process and they know what to do when it goes wrong. We may be able to help you stay in your home. We will not know whether we can prevent your foreclosure until we have spoken with you and reviewed your documents. Frequently asked questions about Virginia civil litigation

I am being sued by a credit card company. I did have an account with the company at one point, but there is no way I owe as much as I am being sued for. What can I do?

Most credit card companies file their lawsuits under the assumption that the consumers that they are suing will either not come to court at all, or will show up and admit that they owe the debt. These lawsuits rarely stand up to vigorous defenses by legal counsel. If you are being sued on credit card debt, there is a good chance we will be able to help you.

I am receiving constant annoying phone calls by debt collectors. It has gotten to the point where I no longer answer my phone. What can I do?

If the entity that is calling you is a third party debt collector or a collection agency (not your original creditor), then that entity is covered by a federal law called the Fair Debt Collection Practices Act (FDCPA). This law limits what third party debt collectors can do to collect debts. Among other things, the FDCPA makes it illegal for collectors to continue to call you after they have received written notification that you do not wish to be called.

I have many debts and I am struggling to get out from under them. I have heard that Bankruptcy works for many people, and I am wondering if it would be a good solution for me.

I have pulled my credit reports and there is information on them that shouldn’t be there. I am having trouble getting a home/car loan as a result.

I am being asked to pay a bill that I don’t believe I should have to pay. What can I do?

TGB frequently handles bill disputes for clients. You do not have to pay for services that were promised, but were not actually performed. If you were quoted one price before you agreed to pay for a service, and then sent a bill for a higher amount, you do not have to pay more than what you were quoted.

My mortgage servicer is considering me for a loan modification under the Federal government’s HAMP program. But I have received one or more notices in the mail threatening foreclosure.

Mortgage servicers that participate in the government’s Home Affordable Modification Program (“HAMP”) are not supposed to foreclose on your home until they have finished reviewing you for a HAMP modification. If you are being threatened with foreclosure while your HAMP review is pending, we may be able to help you.

I am being threatened with foreclosure, but I am current on my loan. My mortgage servicer has not properly applied one or more of my payments. I have tried to straighten this out by calling my mortgage servicer, but nobody will listen to me.

You have the right to clear, transparent communication from your mortgage servicer about the status of your loan. If you believe that your lender is foreclosing on your home because your payments were not correctly applied, and you cannot get anyone to fix the situation, we may be able to help you.

My income has been reduced and I can no longer afford to make my mortgage payment. I am interested in applying for a modification of my loan.

A foreclosure sale of my home has been scheduled for tomorrow. What can I do?

Somebody from TGB needs to speak with you at least ten days before a scheduled foreclosure sale in order to be able to help prevent a foreclosure of your home. If you are being threatened with foreclosure and you believe that you have a defense, you should call us promptly.

My home was foreclosed on last week, but I did not receive notice of the sale before it happened, and my mortgage company had promised me that they wouldn’t foreclose.

My landlord evicted me without notice.  Can he do that?

Under Virginia law you are considered a tenant at sufferance if you do not have a lease and pay rent.  This means that you can be evicted for any reason at all, at any time and no particular notice needs to be given to you.  The person who is letting you live there also does not have to take you to court to evict you and can have you removed (or change locks) at any time.
